RULES: KHELO INDIA SAATH SAATH - KAUN BANEGA CROREPATI (2007 series) CONTEST

Part A: How to enter and participate in the competition
Definitions:

"Competition": General knowledge quiz titled "Kaun Banega Crorepati (2007 series)" and on air referred to as "Kaun Banega Crorepati."

"Company": STAR India Private Limited, the organizer of the competition.

"Contestant(s)": Any person(s) who is eighteen (18) years and above of age, is a citizen of India and is resident of India (as per the definition of "resident" in the Indian Income Tax Act, 1961) and enters the Khelo India Saath Saath Contest accordance with the rules stated below.

"Fastest-Finger first" means that part of the show/episode of Kaun Banega Crorepati (2007 series) where the same question is asked to the selected contestants, who in turn shall answer the same. The first person to correctly answer the question shall be entitled to proceed to the Hot Seat.

"Hot Seat" means the winner(s) of Fastest-Finger first and who sits before the host of the Competition to participate further in the Show.

"Programme": The recordings of the Competition in the Studio (including any seasonal special/s recording).

"Seasonal special/s": Any episode/s of the Show (defined below) specially recorded to celebrate a specific time of year.

"Schedule": an episode or a set of episodes to be recorded and/or recording dates as pre-determined by the Company.

"Show": Episode No. 45 to 52 (both inclusive) of the Programme.

"Show Number and Date": The number and date of recording of the Show in question.

"Special episode/s": Any episode/s of the Programme recorded with Contestants who belong to a category other than that specified hereunder, which may include celebrities or children special, or any other category which may be decided upon by the Company in its sole discretion. Such episodes will have additional rules (as amendments/attachments) to which the Contestants will have to comply with along with all the other rules of the Competition.

"State Special/s": Any episode of the Programme recorded with the Contestants from only a particular state/s.

"Studio": Studio No. 7, Maharashtra Film Stage and Cultural Development Corporation Limited, Film City, Goregaon (East) Mumbai-4000 65 or any such other studio as the Company may nominate.

"Studio Part": That part of the Competition, which takes place in the studio whether or not recorded for transmission.

1. Procedure to participate in the Khelo India Saath Saath Contest:

(a) The Contestant(s) can register his/her telephone number to participate in the Khelo India Saath Saath by dialing from a BSNL or MTNL telephone line number 190 4424 44240 1/2/3/4, depending on the Contestant's option for each of the question.

(b) The Contestants can register his/her telephone number to participate in the Khelo India Saath Saath by dialing the number stated above and punching the answer to the question asked during the Show. On dialing the number (stated above) and punching the answer the telephone number from which the Contestant has called gets registered with the Company for that particular question.

(c) The Contestants can register his/her Airtel mobile number to participate in the Khelo India Saath Saath by calling number 5646 1/2/3/4 depending on the Contestant's option or via SMS: SMS "KBC" to 5646 1/2/3/4, depending on the Contestant's option for each question.

(d) The telephone lines and the mobile lines and SMS acceptance shall be open for each question asked by the Host to the participant in the Hot Seat in the Show from the time the answer options to the question is announced by the Host on the Show until the correct answer is announced by the Host in the Show.

(e) In case the calls and/or SMS with the options are received at/before the commencement of the announcement of the answer options to the question or during the announcement and/or at or after the time when the correct answer is flashed the said entry(ies) shall not be valid.

(f) Incase one (1) or more than one (1) entry from a particular telephone number is received by the Company, in such a case when the Company calls up that particular telephone number and the person who answers the call confirms that he/she is the person who has answered the question correctly, it shall be accepted by the Company.

(g) Calls made by Contestant(s) from BSNL and MTNL as well as Airtel telephone lines only shall be considered as valid entry. Further calls made from PCO, office board lines (EPABX or by any other system) and any other telephone lines shall not be valid entry to participate in the Khelo India Saath Saath.

(h) Telephony, i.e., via landline, mobile (i.e., voice and/or SMS) is the only method by which a Contestant can participate in the Khelo India Saath Saath. Nevertheless the Company reserves the right to introduce any other method/scheme/contest by which Contestants may participate in the Khelo India Saath Saath.

2. Call costs and helpline:

The call cost to the callers calling in from BSNL or MTNL shall be charged 2 pulses per call; Rs. 2.40 per sms and Rs. 2.40 per call for Airtel callers. This does not include roaming charges.

ROUND 1:

The Contestants will be required to punch in the answer option to any question asked to the participant in the Hot Seat by the Host during the Show and the telephone number will get registered with the Company.

The Khelo India Saath Saath Contest shall be open for the Contestants for each Show from the time the answer options to the question are announced by the Host/flashed on the Show until the correct answer is flashed/announced by the Host in the Show.

In case the calls and/or SMS with the option(s) are received before/ at the commencement of the announcement of the answer options to the question or during the announcement and/or after the answer is flashed/announced the said entry(ies) shall not be valid.

3. Upon entry to Khelo India Saath Saath Contest:

ROUND 2:

If the Contestant(s) answer is correct and the telephone number is one of the correct entries who have been selected through computer random selection, the Company will call up on the telephone number registered with the Company.

In order to be identified as the winner of the Khelo India Saath Saath Contest for that particular question asked to the participant in the Hot Seat in the Show, the Contestant(s) will be asked a re-confirmatory question. In the event the answer is correct, the Company shall ask personal details (i.e. full name, permanent present residence address, date of birth, etc.) and information to check the eligibility of the Contestant In case the Contestant is not eligible as per the General Rules, the Contestant will not be eligible to be the winner. The said conversation between the Company and the Contestant(s) may be recorded (solely at Company's discretion).

In case the Contestant is successful in answering the re-confirmatory question correctly and is eligible, as per the Company, the Contestant shall be identified as the winner of that particular question asked by the Host to the participant in the Hot Seat for the Show by the Company, provided that the said Contestant initially furnishes all the necessary appropriate documents to the Company and also signs the faxed copy of the documents, after signing the Contestant is required to faxed them to the number given by the Company.

On the necessary appropriate documents and also the signed copy of the documents being received by the Company, the documents shall be verified with the information provided by the Contestant on the telephone to the Company. After which if the details are correct and the other documents have been correctly signed by the Contestant without any cancellation and/or alteration, the Contestant will be informed that he/she is the winner of Khelo India Saath Saath Contest for that particular question asked in Show. Following which, the original documents of the faxed documents, which were signed by the winner will be couriered/sent by post by the Company to the winner for his/her signatures.

The declared winner will be entitled to receive prize money of Rs. 1,00,000/- (rupees one lakhs only) only for having answered the question correctly which was asked to the participant in the Hot Seat for the Show after the Company has received the necessary appropriate documents and also the original documents signed by the winner/contestant without any cancellation and/or allteration of any manner whatsoever. Failing, which the Company reserves the right to cancel the name of the contestant/declared winner as the winner and identify a new winner for the Khelo India Saath Saath Contest for a particular question which was asked to the participant in the Hot Seat for that particular Show.

PART B: GENERAL RULES

1. Employees of the Company, of the producers of the programme Synergy Communications Pvt. Ltd.,, of Synapse Information Services Pvt. Ltd., of KPMG, of the advertising agency which has been appointed from time to time, and also employees of the main sponsors; and members of their immediate family; persons other than Indian nationals, or Indian nationals living out of India, or those who do not qualify under the definition of "resident" of India as per the Indian Income Tax Act, 1961, are ineligible to enter the Competition. Failure to provide proof or affidavit of eligibility, including the correct date of birth and all other documents as required as per the rules and regulation within a reasonable time upon request by the Company may result in disqualification and/or the withholding or withdrawal of a prize.

2. Contestant is required to furnish necessary supporting documentation in original (i.e., birth certificate, school leaving certificate or passport or any other document(s) as deemed fit by the Company) to confirm the eligibility of the Contestant(s). In case the Contestant has participated in the Khelo India Saath Saath Contest through:

2.1 BSNL/MTNL line, the Contestant is required to submit proof of address (original) and also the telephone bill (BSNL/MTNL) (original) with address, which shall be compared.

2.2 Mobile (post paid), the Contestant is required to submit the mobile bill (original) and proof of address (original), and if it is a different name on the bill, then an NOC from that person.

2.3 Mobile (pre-paid card), the Contestant is required to submit proof of address (original).

3. Contestant is required to furnish and sign and fax and also submit all the necessary documents, as instructed by the Company. The Contestant is required to submit all the documents sent by the Company within twenty-four (24) hours from the date of receiving them. In case the Contestant fails to submit all the original documents duly signed, etc., and all other supporting documents as stated in the rules and regulations, to the Company, the Company reserves the right to disqualify the contestant who has been identified as the winner. For avoidance of doubt, documents shall be considered to be submitted by the Contestant on the Company receiving the original documents from the Contestant.

4. Company reserves the right to flash the name of the contestant who has been identified as the winner. However, the flashing of the winner's name shall not bind the Company to give the prize money to the winner if the details, documents furnished and/or signed by the said winner are inconsistent, as per the Company.

5. On the Contestant fulfilling all the requirements and obligations, the Company shall send the prize money to the Contestant vide a cheque in the name of the Contestant, subject to deduction of tax at source, as per the Indian Income Tax Act, 1961, amended from time to time.

6. Contestant(s) who have participated in the studio part of the Competition for a particular Show or shows cannot participate in the Khelo India Saath Saath Contest for that Show during its telecast and/or otherwise.

7. While answering the question(s) in Round 2, Contestant cannot repeat the question(s), incase the Contestant(s) repeats the question(s), the Contestant shall be immediately disqualified.

8. Incase the Contestant(s) answer is correct in Round 1, Contestant shall receive a call from the Company within four (4) days from the date of the lines of entries getting closed for that particular question.

9. The Company shall make only 1 + 1 (i.e., 2 attempts) attempts to contact the selected Contestant, incase the Contestant cannot be contacted in the 2 attempts the Contestant is disqualified and the Company shall contact the next Contestant with the correct answer and who has been randomly selected by the computer.

10. Contestant(s) must enter the competition on their own behalf and entries by proxy will not be accepted.

11. Only the entries made after the answer options to the question is flashed/announced by the Host on the Show until the correct answer is flashed/announced by the Host in the Show will be considered valid.

12. The Company may refuse to pay winnings or reclaim all sums paid to Winner of the Khelo India Saath Saath in the event of his/her fraud, dishonesty or non-entitlement to participate in the Khelo India Saath Saath Contest under the Rules.

13. In the event of any fault, misunderstanding or dispute concerning any part of Khelo India Saath Saath, and/or the operation of the telephone system, or the validity of any answer the decision of the Company shall be final.

14. The Company reserves the right to amend the Rules or terminate the Competition at any time.

15. All Contestants agree to abide by the Rules including these General Rules.

16. If the operation of the Competition (including without limitation the operation of the telephone system); the recording; broadcast of any/all of the Shows is prevented by an event of force majeure the Company may cancel all or any part of the Competition.

17. The Company has endeavored to make all reasonably practicable arrangements to minimise telephone system difficulties but can make no guarantee therefore.

18. A SMS and/or call shall be acknowledged received by the Company at the time when the Company receives the SMS and/or the call and not when they are sent/made by the Contestant(s).

19. The Company reserves all rights to make amendments to the existing rules without prior notice. The Company shall not be responsible and/or liable in any manner whatsoever in case the Contestant(s) are unable to participate due to failure on the part of the telecom operator, facility provider, etc.

20. Non-conformance by any contestant of the rules of the Khelo India Saath Saath Contest will disqualify them from participation or winnings, immediately, as the case may be.

21. The winner of the Khelo India Saath Saath Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Company and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the winner(s). Further, the winner shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The winner agrees that the footage of any nature with regard to the winner(s) shall vest with the Company, including but not limited to all intellectual property rights and any other rights in all media for worldwide and in perpetuity.

22. The winner(s) and/or the Contestant(s) of the Competition agrees that he/she shall hold harmless the channel, Company, its employees, officers or any other person in connection with the prize won by him/her and/or in relation to the Khelo India Saath Saath including but not limited to the procedure and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against sponsor and/or the channel/Company to claim any damages or reliefs.

23. The Company and/or the channel is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental trauma caused to the contestant(s) and/or the winner (s) in any manner whatsoever, in relation to the Competition and/or prize.

24. The maximum prize which can be won in the Khelo India Saath Saath Contest is Rs. 1,00,000/- (rupees one lakhs only) per question asked to the participant in the Hot Seat during the Show and any and all taxes and/or levies applicable under the laws of India shall be borne by the winner(s) in relation to the prize.

25. If Contestants are unclear as to the rules by sending a stamped and self addressed envelope to the following address: Kaun Banega Crorepati (2007 series),P.O. Box No.37454, J.B. Nagar Post Office, Andheri(E), Mumbai 400059. The Company shall endeavor to the best of it's ability to respond thereto.

26. All or any disputes, difference arising out of or in connection with the terms of the present document shall be subject to arbitration to be conducted by a sole arbitrator, who shall be a senior official of the Company. The arbitration proceedings shall be held under the Arbitration and Conciliation Act, 1996 and the Rules frames thereunder. The place of arbitration shall be Mumbai.The arbitrator shall have no jurisdiction to grant interest. The law governing arbitration shall be Indian law.
